Further to our email of June 8, we inform you that the Road Transport Haulers Association of Brazil – ATR Brasil – has filed a Direct Action for Unconstitutionality (ADI) against Provisional Measure No. 832/2018, on the basis that the setting of standard freight charges “is a high-risk factor for the business activities of all its associates”.

The case will be heard by the Supreme Court, with Justice Luiz Fux as Reporting Justice, the claim may overturn Provisional Measure No. 832/2018 if upheld.

Meanwhile, until a final ruling is handed down, the effects of any injunctions granted in proceedings for suspension of the effects of the Provisional Measure will only benefit companies associated with ATR Brasil.
